TERMS AND CONDITIONS OF Sprizes.com COMPETITION.

1. These terms and conditions together with any specific rules set out in Competition Site (as defined below) are the Competition Rules (“Rules”) and apply to competitions included on the www.Sprizes.com,   website (“Site”), unless otherwise expressly stated.  By entering any of the Competitions, entrants agree to be bound by these Rules.

 2. The Competition is organised by Sitefinders Net Limited (promoter), , Dot Com House, Broomfield Place, Earlsdon, Coventry CV5 6GY

 3. Rules specific to each Competition are displayed on the home page (the “Terms & Conditions”) and are incorporated herein

 4. Sitefinders Net Limited reserves the right to cancel or amend the Competition, the Competition Site or these Rules at any time without prior notice.  Any changes will be posted either within the “News” on the Sprizes Web Site or these Rules

 5. In the event of any dispute regarding the Rules, Terms & Conditions, conduct, results and all other matters relating to a Competition, the decision of Sitefinders Net Limited shall be final and no correspondence or discussion shall be entered into.

 6. This competition is open to all persons aged 18 and over except the Promoter’s employees or members of their immediate family, agents or any other person who is connected with the creation or administration of this competition.

 7. Employees of Sitefinders Net Limited or any company involved in the Competition or, if relevant, or any such person’s subsidiary or associated companies, agents or members of their families or households, are not eligible to enter the Competition Sitefinders Net Limited reserves the right to verify the eligibility of all entrants.

 8. Additional eligibility requirements may apply to a specific Competition, e.g. a valid passport, visas and/or driver’s licence will be required if the Competition prize includes travel outside the United Kingdom and/or car hire.

 9. By entering this competition the entrant will be deemed to have read and understood these rules and to be bound by them and by any other requirements set out in any related promotional material. The competition is governed by English Law and any matters relating to the competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction. By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete. 

 10. By using this web site and entering the Competition (and you warrant that) either you   have legal capacity to enter the Competition and agree to the Rules (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract) or your parents have consented to your entry of the Competition and use of these Rules.

11. Sitefinders Net Limited reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these terms and conditions. 

 12. In the event that any entrant is disqualified from the Competition, Sitefinders Net Limited in its sole discretion may decide whether a replacement contestant should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.

 13. To enter, follow the on screen instructions and then using all the information shown in the photograph, i.e football match, Kite flying or other photograph displayed on the computer screen (from which the original ball, kite or other item has been removed), use your skill and judgement to correctly identify the  position  which you consider  is the most likely position of the centre of the “Item, e.g  ball, kite or other.

Move your cursor where you consider the centre of the Item to be, click  your mouse to capture the “X” & “Y” coordinates as the centre of the Item.  (Coordinates will automatically be entered in the right panel of the screen).

These coordinates will be registered as the centre of the spot as your entry into the competition. Proceed to the payment page, enter your contact and credit card details. Upon completion of your credit card payment you will be contacted via email to confirm your entry into the competition. Competition will only be deemed to have been entered by you, upon confirmation of email stating entry.

14.The Competition will close only when the maximum pre-stated tickets have been sold.

The centre of the ball position or kite or any other “item” required to be located through the use of skills and judgement, will be determined by an independent judge (an appropriate expert appointed by the Promoter), using their knowledge and experience of the sport, in the presence of a lawyer and a representative from the Promoter.

The answer of the judge will be entered into the computer, which will identify one or more competitors as the winner of the prize. The winner will be the person who correctly identifies, or in the event no one is correct, one who is closest to the centre of the “item” (ball or kite or other) is judged to be located. In the event of a tie, cash alternative (see 19) will be shared equally between the winners. All decisions of the judge will be final and binding on the competitors and no correspondence will be entered into.

 15. Competition entries must be made in the manner identified in 13 .  Failure to do so will disqualify the entry.

 16. Sitefinders Net Limited cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control. No responsibility will be accepted for failed, partial or corrupted computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorised human act.

 17. Entrants should note that unless stated otherwise, Sitefinders Net Limited does not accept responsibility for the return of any Competition entries.

18. Prizes will be as those stated in each competition on the www.Sprizes.com  web site.

19. Prize winners will be notified in the manner and within the time specified within 28 days of the closing date from the date the competition is judged.   Tie-breakers will be judged by Sitefinders Net Limited and, if required by law, by an independent adjudicator.  In all matters, the decision of the judge(s) and Sitefinders Net Limited shall be final and no correspondence or discussion shall be entered into.  The maximum cash prize will be  £50,000.

 20. To Claim a prize, the winner will be required to send proof of identity, age and address to the promoters in the form of copy of their passport, utility bill or bank statement, and also prove that the credit card which was used to purchase the ticket(s) was legally theirs or they had authorisation to use it, before any prize will be paid or delivered. Following receipt and verification of the details above by the Promoter, the winner will be contacted in order to make arrangements for delivery of the prize. The Promoters will endeavour to deliver the Prizes to the identified and verified winner with 45 days from the date when the competition has been judged.

21. Prizes are awarded at Sitefinders Net Limited’s discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant.  The prize for competitions are as declared. In a tie, a cash alternative will be spilt equally at judges' discretion. (see 19)

24. Where a prize may not be appropriate for a younger contestant, the minimum age for entry will be stated in the Competition terms and must be observed.  Sitefinders Net Limited reserves the right to request written proof of age of any winner.

25. All taxes, insurances, transfers, spending money and other expenses (including meals or personal expenses  upgrades etc. as the case may be,  unless specifically stated, are the sole responsibility of the prize winner.  

26. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. The Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize-winner and, where applicable, to any family/persons accompanying the winner, or in connection with any of the competitions promoted by the Promoter

27. The Promoter will store the prize free of charge for 14 days after notifying the winner. If the winner has not been able to accept the prize by then a charge of £200 per week will be charged for storage for the next month and increased rates will apply after that. Upon Notification,

Acceptance of the prize by the winner gives the Promoter the right to use the prize-winner’s name for promotional purposes, both immediately after their win and in the future, unless prohibited by law

28. Any information submitted by you must be personal to and relate specifically to you.  You hereby warrant that the information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening.  If relevant, Sitefinders Net Limited reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same. 

29. Sitefinders Net Limited cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the competition or as a result of accepting any prize.  Sitefinders Net Limited is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. 

 30. Data Protection Notice: Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter (i) to administer the competition; and (ii) (unless you tell us that you prefer not to receive direct marketing) to contact you about other competitions or about other goods and services which the Promoter considers may be of interest to you. .In order to process, record and use your personal data the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any organisation (whether or not connected to the Promoter) for the purpose of bringing to your attention goods and services which the Promoter considers may be of interest to you; (iii) any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you; (iv) any person to whom the Promoter proposes to transfer its business or any part of it; (v) comply with any legal or regulatory requirement of the Promoter in any country; and (vi) prevent, detect or prosecute fraud and other crime.

 31. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual’s prior consent. 

 32. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.

 33. The Competition and the terms and conditions of this agreement will be governed by English law.
